Buying or selling a house in Spain

Before you are going to buy your house, it has to been checked by your legal advisor.
He will check:
  1. the Property Registry
  2. the pre – agreement
  3. your personal dates are complete, especially you have to present your NIE number and passport
  4. the taxes IBI (property tax) and all the current costs of the building, in case of an apartment, has to been paid by the seller
The further step will be the preparation of the contract which has to be certified by a notary. To complete the purchase the change of the owner should be inscribed in the Property Registry.

Taxes:
Buying a house, you have to pay ITP which charges the transaction. Only in the case of buying a new house the ITP will be substituted by IVA (=VAT) combinated with AJD which charges the public document.
Selling a house, you have to pay a capital gain tax, which charges the benefits. Signing a contract of purchase with a non resident seller leads to the obligation that the buyer has to withhold 5% of the amount of sale included in the public contract signed before the notary. This money will be paid on the tax account of the seller. He has to declare within 4 months after the date of the purchase contract the whole benefits which will be charged with 35 %. The 5% withheld will be deduced from the final sum. Apart from this, the seller has to pay a local tax, called plusvalía.
